  • No-fault claims: Get compensation even if the driver wasn’t at fault.
  • Time limits: Apply for benefits within 28 days, and make a common law claim within 3 years.

What happened?

  1. Gather information: Get driver details, vehicle registration number, witness contacts, and photos of the scene, damage, and injuries.
  2. Report the accident: Report to the police within 28 days and obtain an event number.
  3. Seek medical attention: See your doctor immediately and document your injuries.

Making your claim

  • Complete the Application for Personal Injury Benefits within 28 days: This is available online on the SIRA website (https://www.sira.nsw.gov.au)
  • Obtain a medical certificate: Your doctor will assess your injuries and lost income.
  • Compensation for the first 12 months: You’ll receive payments for lost income, medical expenses, and care (up to 95% of pre-injury earnings for the first 13 weeks, then 80%).
  • Compensation after 12 months: You may be eligible for ongoing payments and common law damages if:
    • You weren’t mostly at fault for the accident.
    • Your injuries are not considered minor.

Common law damages

This allows you to claim a lump sum for:

  • Pain and suffering (if your impairment is greater than 10%).
  • Loss of income and superannuation.
